Can foreigners buy real estate in Peru?
Foreigners can legally purchase real estate in Peru, as Peruvian law grants them the same ownership rights as Peruvian citizens. The purchase may include apartments, houses, building plots, as well as commercial or agricultural properties.
The only significant restriction is the prohibition for foreigners to acquire properties located within border zones, defined as areas up to 50 kilometers from the national border. This applies in particular to territories of strategic importance, such as forest, water, mining, and energy zones. In exceptional cases, the government may grant permission for such a purchase if the property is intended for public purposes.
The purchase process is relatively simple.
A foreign buyer may complete the transaction personally or through a legal representative, by granting power of attorney at a Peruvian consulate or before a notary public abroad.
Before signing the sale contract, the buyer must obtain a Peruvian tax identification number (RUC) and present a valid passport.
The sale and purchase agreement is drawn up in the form of a notarial deed and then registered with the Public Registry Office (SUNARP), which constitutes the official transfer of ownership.
From a cost perspective, purchasing real estate in Peru involves paying a property transfer tax (known as “Alcabala”) amounting to approximately 3% of the property’s value, after deducting a tax-free threshold.
Additionally, notary, registration, and possible legal service fees should be considered.
In the event of a later sale of the property, any capital gains are subject to taxation, and the rate depends on the owner’s tax status (resident or non-resident).
Peru offers a stable real estate market with high investment potential.
Foreign investor interest continues to grow due to affordable prices, liberal regulations, and the expanding tourism sector — particularly in regions such as Lima, Cusco, Arequipa, and Trujillo.
Therefore, purchasing property in Peru is both accessible and profitable for foreigners, provided that the acquisition takes place outside the restricted border zones.
