Choice of law in the contract: Parties to a contract may choose the law that will apply to their contract. Such a choice should be clearly stated in the contract. For example, the parties may decide that the contract will be governed by Polish law or the law of the country in which the DEVETOPER platform has its branch.
Location of real estate: Usually, in real estate matters, the law of the country where the property is located applies. This means that if you buy a property in e.g.: Spain, it is very likely that Spanish law will apply to the transaction, if you buy in e.g.: Croatia then Croatian law, all this especially in matters directly related to the transfer of ownership.
International Conventions: In some cases, international conventions may apply to determine the applicable law, such as Rome I on contractual obligations, which sets forth rules for choosing the law applicable to civil and commercial contracts.

- What is the 200 euro reservation fee used for when booking transportation or accommodation?
The DEVETOPER platform collects a down payment to ensure certainty of booking for the customer and to safeguard the interests of the property owner. Here are some of the main reasons why a down payment is charged:
- Booking Confirmation: The collection of a down payment confirms that the customer is seriously interested in booking a property and is ready to make a binding reservation.
- Securing the owner’s interests: Collecting a down payment gives the property owner the assurance that the property will be reserved for a specific date, which can be important in cases of limited property availability or during periods of high demand.
- Reducing the risk of no-shows: Collecting an advance payment can reduce the risk of no-shows, which is when a customer makes a reservation but doesn’t show up. With an advance payment, the customer makes a financial commitment and is more likely to honor the booking deadline.
- Covering administrative costs: The DEVETOPER platform collects an advance payment to cover administrative costs related to reservation processing, customer service and any cancellation or change fees.
Collecting a down payment is therefore a way to secure the reservation, both for the customer and the property owner, and can help improve the efficiency of the booking process. It is advisable to carefully read the terms and conditions of the reservation before making a booking.

- What rate of VAT does a real estate agent from Poland add to the invoice when sending a commission invoice to Spain?
Article 28 of the Polish Value Added Tax (VAT) Law determines in which country a service should be subject to VAT.
According to Article 28, the rule of thumb is that the place of supply of services to taxpayers is the place where the recipient of the service has a place of business. This also applies to the place where the property being sold is located. Therefore, a real estate broker from Poland, regardless of whether he is registered for EU VAT, will issue an invoice with a 0% VAT rate.
Article 28 is crucial for entrepreneurs providing services on an international scale, as it determines where VAT should be paid for services rendered. Correctly determining the place of supply of services is important to avoid double taxation or non-taxation.

The broker must clearly inform the client about the purpose, scope, and method of data processing—formal consent serves as proof of this.🚫 Without this consent, the broker cannot legally act on the client’s behalf, which could lead to legal or financial consequences for the business.
- Where can I find the GDPR attachment for signing?

- Why is it worth signing a loyalty agreement with DEVETOPER?
Signing a loyalty agreement with the DEVETOPER platform offers brokers a range of benefits and safeguards that strengthen their market position and ensure stable, long-term income:
1. 🔒 Guaranteed client assignment
Each client referred by the broker is assigned to them for 2 years from their first contact with the platform.
This guarantees that the broker’s effort in acquiring the client will be rewarded, regardless of future steps taken by the client.
2. 💰 Secure and transparent earnings
The broker receives commission from every transaction made by their assigned clients—regardless of property location.
Commissions are paid monthly, based on a transparent transaction log, ensuring stable and predictable income.
3. 🚫 Exclusive client ownership
The system prevents a client from being assigned to multiple brokers.
If a client is already assigned, any attempt to reintroduce them will be automatically blocked.
This protects the broker’s efforts in client acquisition.
4. 🔁 Long-term client relations
Even if a client makes additional purchases in the future, the broker continues to receive commissions on those deals for 2 years from the client’s initial registration.
5. 🤝 Support from the DEVETOPER platform
DEVETOPER commits to regularly reporting all transactions from assigned clients, making it easier for brokers to track performance and income.
The platform also ensures legal compliance, including with data protection laws (GDPR).
6. 🌍 Stronger market presence
Cooperating with DEVETOPER gives the broker access to a global property platform, appealing to clients interested in buying abroad.
This boosts the broker’s professional image and prestige.
7. 📄 Low risk and flexibility
The agreement can be terminated with 3 months’ notice, offering flexibility if cooperation terms change.
Importantly, ending the agreement does not cancel commissions already earned from assigned transactions.
In summary:
Signing a loyalty agreement with DEVETOPER helps you increase your earnings, protect your interests, and build long-term relationships with clients — all within a transparent and professional framework. - When is a client assigned to a specific broker?

- Unified tools (e.g., CRM systems, internal platforms, databases)

- Does a DEVETOPER partner branch in exotic locations charge an additional commission when purchasing a new property?
In some cases — unfortunately, yes. This applies especially to certain markets such as Croatia, where local partner agencies may charge an additional commission to the client, typically around 3% of the property’s value.
It’s always recommended to ask in advance whether a particular branch applies such fees, as practices may vary by country or region.
- How to properly send a client through the DEVETOPER platform?
To ensure that sending a client through DEVETOPER is effective and results in a successful transaction, it’s essential to pre-qualify the client carefully before submission.
🔍 What should you pay special attention to?
- Avoid random leads
Do not send clients based on casual Facebook comments or generic leads from portals like Gratka or Morizon.
➤ We need verified contacts who are genuinely interested in buying. - Have an initial conversation
Before submitting, speak with the client to understand:- Preferred property type
- Desired location
- Budget
- Expected features/amenities
- Any special requirements
- Check for prior agency involvement
Ask if the client is already in contact with other brokers or agencies in the target country.
❗Why is this critical?
Sometimes a local DEVETOPER branch arranges viewings and invests time, only to find that the client has already booked with another agency, causing wasted effort and missed opportunities.➤ Result: No-shows, confusion, and lost resources — for both the Partner and DEVETOPER.
✅ Summary: Best Practices for Sending Clients
- ✔️ Send only verified, qualified clients
- ❓ Ask the right questions to identify potential conflicts with other brokers
- 💬 Confirm that the client is genuinely interested and ready to cooperate
- 🚫 Avoid so-called “empty submissions” that disrupt local branch operations
- 💼 Only clear and well-prepared cooperation leads to success — and commission.
🎯 Remember:
Your preparation = your reputation
Well-qualified clients = successful transactions = your earnings. - Avoid random leads
- How is a client assigned to a specific branch responsible for a listing?
Every listing added to the DEVETOPER platform is automatically assigned to the administrator (branch) that published it — they become the official point of contact for that offer.
So when a real estate agency sends a client interested in a specific property, the system automatically routes the client to the administrator responsible for that listing.
This ensures that inquiries are handled by the right local expert, familiar with the property and market. - Why should all communication take place exclusively through the DEVETOPER system?
The DEVETOPER platform places strong emphasis on transparency and security in communication between brokers, local branches, and the platform itself.
To ensure proper transaction handling and the guaranteed payout of commissions, all messages, chats, documents, and communications must be conducted exclusively through the internal DEVETOPER system.
🔐 Why is this so important?
- ✅ Commission is only guaranteed if the entire process is managed within the DEVETOPER system.
- ❌ If external tools are used (e.g. Messenger, WhatsApp, personal email), the platform has no access to message history or attached files — making verification impossible and commission payout non-guaranteed.
- 📁 The internal system automatically archives all communication, and data is backed up daily on secure, high-capacity servers.
- 🧾 Every conversation, file, and agreement is fully traceable within the system — providing protection for both the broker and the branch.
✅ Bottom line:
Whether communication is between a broker and a branch, or internally between branches — all actions must go through the DEVETOPER system.
Only then can the platform oversee the process, ensure transparency, and guarantee proper commission payment.
- Why do commission rates on the DEVETOPER platform vary by country?
Commission rates on the DEVETOPER platform can differ depending on the country where the transaction takes place. For example:
- 🇪🇸 In Spain, the commission can reach up to 50%
- In other countries, it may be 40%, 30%, or even 25%
📊 Why do these differences exist?
1. 🌍 Different market models
Each country has its own system of cooperation with developers and its own way of determining commissions. For example:
- In some countries, the entire commission is paid by the developer
- In others, the commission is split, with part paid by the developer and part by the client
2. 📏 No global standard
There’s no single, global rule for commission structures.
Commission practices depend on:- Local market norms
- Developer agreements
- Legal and cultural expectations
✅ What does DEVETOPER guarantee?
- The minimum commission is never below 25%
- In fact, 30% is guaranteed as the minimum for brokers working through the DEVETOPER system — regardless of the country
This ensures fair, stable, and transparent cooperation across all international markets.
- What documentation should a DEVETOPER branch send to the broker?
The branch administrator is required to provide the broker with complete documentation related to the transaction. These documents may be sent in their original form and typically include:
📄 Reservation agreement
📄 Preliminary (pre-sale) agreement
📄 Final purchase agreement
📄 Any other documents related to the course of the transaction
🎯 Purpose of sharing documentation:
- To ensure full transparency of the transaction process
- To give the broker insight into the status and terms of the transaction involving their client
- To allow the broker to track progress, understand all financial details, and respond to the client’s needs in real time
✅ This practice builds trust, professionalism, and seamless cooperation between the broker, the client, and the DEVETOPER branch.
- What happens if a client visits but decides not to purchase a property?
It’s not uncommon for a client to arrive for a property viewing but ultimately not proceed with a purchase. This situation is fully understood and anticipated by DEVETOPER administrators. Common reasons include:
- The client scheduled meetings with multiple agencies or developers
- The client attempts to buy independently, outside of the official process
- The client was never fully committed, and simply wanted to learn more about the process
- The client misled the broker, either intentionally or unknowingly
🔄 How is this handled?
In such cases, the administrator is required to report the situation through the internal DEVETOPER system, providing a clear explanation of what happened.
This ensures the broker who referred the client stays informed and does not feel ignored or misled.
🤝 Why does this matter?
Clear, transparent communication between the administrator and broker is essential for:
- Maintaining trust
- Ensuring smooth cooperation
- Understanding client behavior and improving future interactions
Even when no transaction occurs, professional reporting builds long-term partnerships and helps everyone involved stay aligned.
- Client Responsibility Guidelines on the DEVETOPER Platform
Client Responsibility Guidelines on the DEVETOPER Platform
The responsibility for handling a client on the DEVETOPER platform depends on the stage of the transaction process and on which branch is operationally involved at a given time. The process is divided into two main stages:
1. Before the Client Arrives at the Destination Branch
Until the client physically arrives at the destination branch, full responsibility lies with the broker who submitted the client.
The sending broker is responsible for:
- Verifying the client’s motivation and genuine interest in purchasing
- Determining the client’s preferences (location, budget, property type)
- Clarifying the purpose of the purchase (investment, residence, vacation)
- Selecting relevant property listings and sending them along with the client’s details to the destination branch
Example:
If a broker from Warsaw sends a client to Malaga, the Warsaw office is responsible for all preparation until the client physically arrives in Malaga.
2. After the Client Arrives at the Destination Branch
Once the client arrives at the destination location, the local branch takes over full responsibility for handling the client.
The destination branch is responsible for:
- Airport pickup (if applicable)
- Arranging accommodation
- Conducting property viewings tailored to the client’s profile
- Verifying documentation and legal status of properties
- Managing the transaction through to final completion
Example:
After landing in Malaga, the Malaga branch becomes fully responsible for the client’s experience and purchase process.
3. This Rule Applies Globally
These rules apply to all broker-branch collaborations, regardless of the countries involved.
Example:
If a broker from Olkusz (Poland) sends a client to Thailand, the Olkusz broker holds responsibility until the client arrives, then the Thailand branch assumes control.
✅ Summary
The DEVETOPER system operates on a clear division of responsibilities, ensuring a transparent, efficient, and professional process for serving clients across all international markets. This structure enhances trust, reduces confusion, and ensures smooth cooperation at every stage.
- Can a DEVETOPER branch unilaterally reduce the transaction price?
No, a DEVETOPER branch must not independently decide to lower the transaction price without prior consultation with:
- The broker who referred the client, and
- The DEVETOPER platform (central administration)
⚠️ What happens if a branch lowers the price without approval?
- The commission owed to the broker and the platform remains unchanged
- It is calculated based on the originally agreed transaction value
- The entire cost of the discount is absorbed by the branch that made the unauthorized decision
🔁 Applies to inter-branch client transfers too
If one branch transfers a client to another branch, and the receiving branch decides to offer a discount, that decision must be:
- Approved by the sending branch, and
- Consulted with DEVETOPER central
✅ In summary:
All price adjustments must be clearly agreed upon and approved by all parties involved to ensure transparency, protect broker commissions, and avoid unnecessary financial loss or misunderstandings.
- How to properly direct listings published on social media?
As a broker sharing property listings on your social media channels, it’s important to remember:
🚫 Do not direct individual clients to the DEVETOPER platform.
The DEVETOPER platform is exclusively for brokers and does not serve end clients.
✅ What should you do instead?
Your posts should include only your own contact information, such as:
- 📞 Your phone number
- 📧 Your email address
- 🌐 A link to your website
You are the direct point of contact for any inquiries about the listing.
📦 What tools does DEVETOPER provide to help you promote listings?
- ✅ Listings in XML format for easy integration
- ✅ Customizable widgets you can generate in the Broker Panel
- ✅ Original property videos ready to download
- ✅ Listings without logos or watermarks – fully ready for your personal branding
🎯 Pro Tip:
Be creative!
Use engaging visuals, videos, and informative captions – but always make sure that all contact paths lead directly to you, not to the DEVETOPER platform. - Are knowledge base questions related to specific countries moderated by administrators?
Yes, questions in the knowledge base are usually moderated or verified by administrators responsible for each respective country.
DEVETOPER actively encourages all administrators to contribute to the development of the knowledge base. If there are:
- Additional questions
- Country-specific challenges
- Important legal or procedural insights
- Common pitfalls in property transactions
…administrators can submit and expand the knowledge base with accurate answers and guidance.
✅ This ensures that the knowledge base remains comprehensive, reliable, and valuable — both for brokers and for clients working across different markets.
- Sample Commission Settlement – Example from Turkey
Here’s a step-by-step breakdown of how a typical commission settlement works on the DEVETOPER platform for an international property transaction — in this case, in Turkey.
🏠 Property price: €500,000
💰 Developer’s commission: 5% → €25,000 total commission
🔄 Commission Distribution (outside Spain – e.g., Turkey):
In non-Spanish markets like Turkey, the local administrator manages the entire commission amount.
Turkey’s standard commission split:
- 30% goes to the broker in Poland who referred the client
- 70% remains with the local administrator in Turkey
So from the €25,000:
- ✅ €7,500 → to the Polish broker
- ✅ €17,500 → stays with the Turkey administrator
🧾 DEVETOPER Platform Fee:
A 2.5% platform fee is charged to both the broker and the administrator, calculated separately from their respective commission shares.
- 2.5% of €7,500 = €187.50 (broker’s share)
- 2.5% of €17,500 = €437.50 (administrator’s share)
- ✅ Total DEVETOPER fee = €625
📦 Settlement Summary:
- DEVETOPER issues an invoice to the Turkey administrator for a total of €8,125, broken down as:
- €7,500 – for the broker’s commission
- €625 – platform fee
- After the Polish broker sends their VAT invoice, the platform pays out €7,500 to the broker.
- The remaining €17,500 (less €437.50 fee) is managed locally by the Turkish administrator.
✅ Key Takeaways:
- Commission split and local handling depend on the country’s system
- DEVETOPER ensures transparent invoicing and payout
- The broker receives their full commission once the required documentation is submitted
- The platform retains a modest, fixed handling fee from both sides to maintain the system
This structure guarantees clarity, fairness, and efficiency across international transactions.
- Does the DEVETOPER Platform always participate in commission payouts to brokers (e.g., from Poland) when a property is sold in another country?
Yes – DEVETOPER always participates in every commission payout, regardless of the country in which the transaction takes place.
🔍 Why is DEVETOPER involved?
To ensure:
- Full transparency
- Security of settlements
- Reliable, on-time commission payments
- Protection of the broker’s interests, especially those referring clients across borders
💼 How does it work in practice?
Let’s say a Polish broker refers a client to a local administrator in Thailand, and the client purchases a property.
Here’s what happens:
- ✅ DEVETOPER issues a commission invoice to the local administrator (in this case, in Thailand), which includes a 2.5% handling fee based on the administrator’s commission share.
- ✅ Once the administrator makes the payment, the Polish broker issues a commission invoice to DEVETOPER — their commission amount is also subject to a 2.5% handling fee.
🔁 The 2.5% handling fee is charged separately to each party:
- One from the local administrator’s share
- One from the broker’s share
🛡️ Why is this structure used?
This system:
- Secures the broker’s commission, especially in international transactions
- Ensures clear, timely, and rule-based payouts
- Reduces risks of delays, disputes, or unpaid commissions
✅ Summary:
DEVETOPER’s presence in the payout process ensures that:
- All parties are protected
- Every transaction is traceable
- Brokers always receive their commission, as long as the proper procedures and invoicing are followed
It’s a trusted, structured system designed to maintain professionalism and fairness across all global transactions.
- If a client is interested in properties in multiple countries, does each administrator managing those locations receive the inquiry?
Yes — each administrator responsible for the selected locations receives a separate notification.
🔄 How does it work?
If a client is planning a trip and wants to view properties in, for example, Thailand, Croatia, and Greece, the DEVETOPER system will:
- Automatically notify all relevant administrators
- Each administrator receives an individual inquiry related specifically to the properties they manage
- The notification includes details of the client’s interest and potential visit
🧭 Who receives what?
From the Broker Panel, if the broker selects properties in multiple countries, the system:
- Sends a message to the Thailand administrator regarding Thai listings
- Sends a separate message to the Croatia administrator for Croatian offers
- And likewise for Greece
Each admin is only notified about the properties they uploaded and are responsible for on the DEVETOPER platform.
📋 What can each administrator do upon receiving the inquiry?
- ✅ Verify property availability
- ✅ Prepare additional, matching listings
- ✅ Organize property viewings
- ✅ Plan and coordinate the client’s visit in their country
This process ensures that each location is professionally handled and the client receives personalized attention, regardless of how many countries they are exploring.
- In what currency does the agent issue an invoice?
All settlements with the DEVETOPER platform are carried out exclusively on the basis of invoices issued in euros.
- Is it possible to transfer the commission to the agent's private account?
No. As a commercial company, DEVETOPER SPAIN S.L. makes transfers exclusively to business accounts, based on an issued invoice.
